Mutual Recognition Agreement
Article 1: Purpose
The purpose of this Mutual Recognition Agreement ("Agreement") is to establish a framework of cooperation between the Parties in order to recognize the equivalence of specific processes, standards, and procedures, thereby facilitating trade, reducing technical barriers, and enhancing mutual economic benefits.
Article 2: Definitions
For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below:
2.1 "Parties"
Refers to the signatories of this Agreement who are entering into mutual recognition commitments.
2.2 "Equivalence"
Means that the processes, standards, or procedures of one Party are deemed to meet the same objectives and outcomes as those of the other Party.
2.3 "Technical Barriers"
Includes any regulation, standard, or measure that affects the trade of goods or services between the Parties.
Article 3: Scope
This Agreement shall apply to the goods and services, processes, standards, and procedures enumerated in Annex I, which is appended to this Agreement and forms an integral part hereof.
Article 4: Recognition
Each Party agrees to recognize the conformity assessment results issued by designated authorities of the other Party in respect to the processes, standards, and procedures set forth in Annex I.
Article 5: Obligations of the Parties
5.1 Consultation and Evaluation
The Parties agree to engage in regular consultations and evaluations to ensure the effective implementation and operation of this Agreement.
5.2 Notification
Each Party shall notify the other of any changes to its relevant regulations, standards, or procedures that might affect the terms of this Agreement.
Article 6: Annexes
Annex I and any subsequent annexes that may be added by mutual consent shall form an integral part of this Agreement, setting forth specific details, including but not limited to the sectors covered.
Article 7: Dispute Resolution
Any dispute arising from the interpretation or application of this Agreement shall be settled amicably through consultations and negotiations between the Parties.
Article 8: Signature and Effective Date
This Agreement shall enter into force on the date of the last signature by the duly authorized representatives of the Parties.
