This Agreement for Mutual Termination of Lease ("Agreement") is entered into on this January 4, 2095 by and between [Your Name], hereinafter referred to as "Landlord," and Anita Wehner, hereinafter referred to as "Tenant." The purpose of this Agreement is to mutually terminate the lease agreement originally entered into on December 4, 2094 for the property located at Tucson, AZ 85701 ("Premises").
WHEREAS, Landlord and Tenant entered into a Lease Agreement dated December 4, 2094;
WHEREAS, both parties mutually desire to terminate the Lease Agreement before its original expiration date of December 4, 2094;
NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein, both parties agree as follows:
The parties agree that the Lease Agreement shall be terminated effective as of February 6, 2095 ("Termination Date").
On or before the Termination Date, Tenant shall surrender the Premises to the Landlord in a clean and good condition, reasonable wear and tear excepted, and shall return all keys, access devices, and any other property belonging to the Landlord.
Upon surrender of the Premises, both parties shall be released from all obligations and liabilities under the Lease Agreement, except for those that expressly survive termination according to the terms of the Lease.
The Landlord shall return the security deposit provided by the Tenant at the inception of the Lease, less any lawful deductions, within 30 days from the Termination Date.
Both parties release each other from any and all claims, demands, or causes of action, whether known or unknown, arising out of or in connection with the Lease Agreement as of the Termination Date.
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona.
