Military Service Credit Agreement
This Military Service Credit Agreement (hereinafter referred to as "Agreement") is made and entered into on this 19th day of August, 2068, between LunaPak with a business address at Irvine, CA 92602, (hereinafter referred to as the "First Party"), and Chloe Emard with a business address at Santa Ana, CA 92701, (hereinafter referred to as the "Second Party"). Both parties agree to be bound by the terms and conditions set forth in this Agreement.
1. Purpose
The purpose of this Agreement is to outline the terms and conditions under which military service will be credited to the Second Party, in accordance with applicable laws and regulations, hereby enabling the Second Party to gain specified service credits towards retirement benefits or other entitlements as stipulated by governing bodies and frameworks.
2. Definitions
2.1 Military Service
"Military Service" refers to active duty service in the United States Armed Forces, which includes the Army, Navy, Air Force, Marine Corps, Coast Guard, and any other service branch recognized by federal law.
2.2 Service Credit
"Service Credit" means the acknowledgment of time served in military duty that will be considered as a factor in calculating benefits and entitlements in civilian employment.
3. Terms of Credit
The Second Party is to be credited for 5 years of military service starting from January 15, 2069 to January 14, 2074. Such credit is to be applied to the Second Party's record with LunaPak.
4. Responsibilities of the First Party
The First Party is responsible for evaluating the verification documents presented by the Second Party and ensuring that the military service credit is accurately reflected in the applicable records within 60 days after the effective date of this Agreement.
5. Verification of Military Service
The Second Party must provide official documentation of military service, such as DD Form 214 or equivalent, for verification. The First Party reserves the right to request additional documentation if needed.
6. Governing Law
This Agreement shall be construed and governed in accordance with the laws of the State of California, without reference to its conflict of law principles.
7. Entire Agreement
This Agreement constitutes the complete and exclusive statement of the agreement between the Parties, superseding all prior proposals and agreements, oral or written, and all other communications between the Parties relating to the subject matter of this Agreement.
8. Amendment
This Agreement may only be amended or modified by a written agreement signed by both Parties.
9. Counterparts
This Agreement may be executed in counterparts, each of which will be deemed an original but all of which together will constitute one and the same instrument.
