This Meal Period Waiver Agreement ("Agreement") is made and entered into as of January 6, 2050, by and between:

WHEREAS

The Employee is employed by the Employer in the position of Software Engineer; and
The Employee is aware of their rights under applicable labor laws to take a meal break during their workday; and
The Employee is voluntarily choosing to waive their right to a designated meal break by the terms outlined in this Agreement.

NOW, THEREFORE

For and in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Meal Break Waiver

The Employee voluntarily waives their right to a 30-minute meal break during their scheduled work hours. The Employee understands that they are not entitled to such a break unless otherwise requested in writing.

2. Work Schedule

The Employee's normal work schedule is from 9:00 AM to 6:00 PM, Monday through Friday. During these hours, the Employee acknowledges they will not take a meal break unless requested in writing by the Employer.

3. Acknowledgment of Legal Rights

The Employee acknowledges they are aware of their legal right to take a meal break and have made this decision voluntarily. The Employee understands that this waiver is not a requirement of employment and that they can revoke this waiver at any time by notifying the Employer in writing.

4. Revocation of Waiver

The Employee may revoke this Meal Period Waiver at any time by providing written notice to the Employer. Upon revocation, the Employer agrees to provide the Employee with a meal period by applicable labor laws.

5. Employer’s Obligation

The Employer agrees that if the Employee chooses to revoke this waiver, the Employer will ensure that the Employee receives their meal break as required by law.

6. No Retaliation

The Employer will not retaliate or discriminate against the Employee for revoking this waiver or for exercising their legal rights regarding meal periods.

7. General Provisions

a. This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof.


b. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.


c. This Agreement is governed by the laws of the state of California.
