1. Introduction
1.1 Parties
This Vacation Rental Agreement ("Agreement") is entered into between [YOUR NAME], hereinafter referred to as the "Property Owner", and [Renter's Name], hereinafter referred to as the "Renter".
1.2 Property Description
The Owner agrees to rent out the beachfront property located at 123 Ocean Avenue, Santa Monica, California, including all furnishings, fixtures, and appliances therein, referred to as the "Property".
1.3 Rental Period
The rental period shall commence on July 1, 2050, at 3:00 PM and shall terminate on July 8, 2050, at 11:00 AM.
2. Rental Terms
2.1 Rental Fee
The Renter agrees to pay a total rental fee of $2,500 for the entire rental period.
2.2 Payment Schedule
A deposit of $500 is due upon booking to secure the reservation. The remaining balance of $2,000 is due 30 days before the check-in date.
2.3 Security Deposit
A security deposit of $500 is required to cover damages or excessive cleaning fees. The security deposit will be refunded within 14 days after the check-out date, provided there are no damages or violations of the terms of this Agreement.
2.4 Taxes and Fees
The rental fee is subject to applicable taxes and a cleaning fee of $150.
2.5 Accepted Payment Methods
Payments can be made via credit card or bank transfer.
3. Booking and Cancellation Policies
3.1 Booking Process
To book the Property, the Renter must complete and sign this Agreement and provide the required deposit.
3.2 Cancellation Policy
Cancellation by the Renter must be made in writing at least 30 days before the check-in date to receive a full refund. Cancellations made after this period will result in forfeiture of the deposit.
3.3 Refund Policy
No refunds will be provided for early departure or unused portions of the rental period.
4. Property Rules and Regulations
4.1 Occupancy Limits
The maximum occupancy of the Property is six guests. Exceeding this limit without prior approval from the Owner will result in additional charges.
4.2 Use of Property
The Property shall be used solely for residential purposes by the Renter and their authorized guests.
4.3 Smoking Policy
Smoking is strictly prohibited inside the Property. Smoking is only permitted in designated outdoor areas.
4.4 Pet Policy
Pets are not allowed on the premises without prior approval from the Owner. Additional fees and restrictions may apply.
4.5 Noise and Disturbances
The Renter agrees to respect the peace and privacy of neighboring properties and refrain from excessive noise or disturbances.
4.6 Parking Regulations
Parking is available for up to two vehicles only. Parking in unauthorized areas may result in towing at the Renter's expense.
4.7 Maintenance Responsibilities
The Renter agrees to maintain the Property in a clean and sanitary condition and promptly report any damages or maintenance issues to the Owner.
4.8 Access to Property
The Owner or authorized personnel may enter the Property during the rental period for maintenance, repairs, or inspections.
5. Liability and Insurance
5.1 Liability Waiver
The Renter agrees to hold the Owner harmless from any liability for personal injury, loss, or damage to personal property arising from the Renter's use of the Property.
5.2 Property Insurance
The Property is covered by insurance for structural damage and liability. The Renter is encouraged to obtain renter's insurance to cover personal belongings and liability.
5.3 Renter's Insurance
The Renter acknowledges that the Owner's insurance does not cover personal belongings and is responsible for obtaining their own renter's insurance.
6. Property Condition and Maintenance
6.1 Check-in and Check-out Procedures
Check-in time is at 3:00 PM, and check-out time is at 11:00 AM. Late check-outs may incur additional charges.
6.2 Property Inspection
The Renter agrees to inspect the Property upon arrival and report any damages or concerns to the Owner within 2 hours of check-in.
6.3 Reporting Damages
The Renter agrees to report any damages or breakages to the Owner immediately and is responsible for the cost of repair or replacement.
6.4 Maintenance Requests
Maintenance requests should be reported to the Owner promptly, and the Owner will make reasonable efforts to address them promptly.
7. Dispute Resolution
7.1 Governing Law
This Agreement shall be governed by the laws of the State of California.
7.2 Mediation
Any disputes arising from this Agreement shall first be resolved through mediation, conducted by a mutually agreed-upon mediator.
7.3 Arbitration
If mediation is unsuccessful, any unresolved disputes shall be submitted to binding arbitration by the rules of the American Arbitration Association.
7.4 Legal Expenses
Each party shall bear their legal expenses incurred in resolving disputes arising from this Agreement.
8. Miscellaneous
8.1 Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral.
8.2 Amendments
Any amendments to this Agreement must be made in writing and signed by both parties.
8.3 Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.4 Notices
All notices and communications between the parties shall be in writing and delivered by email or certified mail.
8.5 Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, and government actions.
