This Agreement is entered into between the above-named parties. Each party has equal ownership of the Land, unless otherwise stated.

II. Purpose of the Agreement

The primary purpose of this Agreement is to establish the rights, responsibilities, and obligations of each party regarding the ownership, use, and management of the Land. This Agreement covers the following use cases:

  • Co-Ownership of Land

  • Property Purchase and Sale

  • Property Development

  • Land Inheritance and Estate Planning

  • Land Trusts and Conservation

  • Dispute Resolution

III. Ownership Rights and Responsibilities

The parties agree that each Owner holds an equal share of the Land, and each has the right to use the Land in accordance with this Agreement. The Owners agree to:

  1. Share in the profits and losses resulting from the use of the Land.

  2. Contribute to the maintenance, taxes, and any other costs associated with the Land.

  3. Consult with one another before making decisions that may affect the Land's use or value.

The Owners may agree to amend these responsibilities based on mutual consent, subject to legal requirements.

IV. Land Transfer and Sale Terms

In the event that any Owner wishes to transfer or sell their share of the Land, the following conditions will apply:

  1. Notification Requirement: The Owner wishing to transfer their share must notify the other Owner(s) at least 60 days in advance of the intended sale or transfer date.

  2. Right of First Refusal: The other Owner(s) will have the right to purchase the transferring Owner’s share before it is sold to a third party.

  3. Sale Price Determination: The sale price will be determined based on an independent appraisal conducted by a licensed appraiser.

V. Land Use Restrictions

The Owners agree to adhere to the following use restrictions for the Land:

  2. Arbitration: If mediation does not resolve the issue, the dispute will be settled by arbitration under the laws of the state in which the Land is located.

VII. Termination and Amendments

This Agreement shall remain in effect until terminated or amended by the mutual consent of all Owners. Any amendments must be made in writing and signed by all parties involved. The termination of this Agreement can occur under the following conditions:

  • A unanimous decision by all Owners to dissolve the agreement.

VIII. Miscellaneous Provisions

  3. Entire Agreement: This Agreement represents the entire understanding between the parties and supersedes any prior oral or written agreements.
